As best you can recall it today, what time did you go out to the fairgrounds that evening? |

Must have been around four or five, I’m not sure. |

Who did you go out to the fairgrounds with? |

My wife and my kids. |

Yup, my brother and sisters. |

They were with – also with their family, their girlfriends and kids. |

When you got out to the fairgrounds, what did you do? |

We walked around with the kids, and then went under the tent for awhile, cause it started raining. |

Was there some point at which you went out to the Midway, where the rides were? |
| A |
Yup, it was after we bought bracelets for my kids. |

It’s been awhile since I’ve been out at the fairgrounds, what does a person buy bracelets for? |
| A |
So they can ride any of those rides without paying each time they get on. |

So you actually kinda prepay for the rides and they give you a bracelet, is that what you’re explaining? |
| A |
Yes. |

While you were in the area at the fairgrounds where there were rides, was there some sort of an incident that took place? |
| A |
Yes, it was right when my wife took the kids to get on a ride. I seen a big old group of people coming towards my brother, it was like twenty or something, and then one of them said something to my brother and just swung at him. My brother, you know leaned back to avoid the punch, and I seen that he was out numbered, so I went over there to try to help him out –knowing that I was, you know, I was going to help or anything. And that’s when everything started, everybody started beating up on me, I guess like four or five people on me, I guess. Cause I tried to take one on, but I was getting hit, kicked and punched, and then all of a sudden I felt real hard shots on my head, and it’s like I guess multiple hits with a bat on the head. And the last one hit me on the top of the head right here, and that’s what made me, like black out for a second, and that’s what made me drop down to the ground. And I got back up after that, and that’s when everybody just took off running. |

What kind of injury did you suffer out at the fairgrounds? |

Just mostly just head injuries, the only spot they actually hit me. |

Did you loose any blood? |
| A |
Yup. |

Why did you lose blood? |
| A |
Cause I was hit with the bat in the head and it cut my head open. |

Did you receive medical attention that night? |
| A |
Yes I did. |

What did they have to do in order to close the cut on your head? |

Put sixteen staples. |

Since that evening have you continued to suffer medical problems as a result of what happened that evening? |

I have strong headaches where I have to miss work, and also have memory loss, short memory loss. |

So frankly you not only had your scalp split open, but inside of your head – inside your skull, your brain was damaged, is that correct? |
